What Probate Is
Chad explains that probate is simply the government oversight of settling an estate. There’s a misconception that probate is about settling assets, but it’s more so about settling liabilities and ensuring that the deceased’s family members don’t take advantage of the estate.
The Exemptions to Probate
Most estates will go through probate. However there are a few exceptions:
- If a living trust exists.
- If your net worth is lower than $100k.
- If the property involved is held with a transfer on death clause.
